Terms of service
These terms are an agreement between you and us about a piece of software. The part people most often miss is the third section: your WhatsApp Business Account is yours, Meta's terms apply to you directly, and we cannot agree to them on your behalf.
In effect from 4 September 2026 · last updated 6 October 2026 · talkv, operated by Talkv
1. Who we are
talkv is operated by Talkv (“we”, “us”, “talkv”), a sole proprietorship based in India.

“You” means the business that opens an account, and anybody you invite into it. If you are agreeing to these terms on behalf of a company, you confirm you are authorised to do so.
These terms, together with our privacy policy and our acceptable use policy, are the whole agreement between us about the service. Where they conflict, these terms take precedence, except that the acceptable use policy prevails on questions of what may be sent.
2. What talkv is, and what it is not
talkv is software that connects to the WhatsApp Business Platform on your behalf. It lets you import contacts, manage message templates, build audiences, send template broadcasts, reply from a shared inbox and read reports about what happened.
We are a Tech Provider on the WhatsApp Business Platform. We are not a Solution Partner and we do not resell WhatsApp messages. In practice this means:
- Your WhatsApp Business Account is registered to you and remains yours, including if you stop using talkv.
- You attach your own payment method to that account, and Meta charges you directly for WhatsApp conversations at Meta’s rates. We never receive, hold, collect or pass on those amounts, and we are not told what they were.
- What we charge you for is the software, as set out in section 7. It is a separate amount on a separate bill.
We are not a payment service, a money transmitter, or an agent for collecting payments on behalf of Meta or anybody else. Any balance you hold with us buys our software and nothing else: it cannot be transferred to another workspace, spent with a third party, or withdrawn as money.
3. Your WhatsApp Business Account and Meta’s terms
Meta’s terms apply to you directly and we cannot accept them for you. If Meta restricts or removes your WhatsApp Business Account, talkv cannot send on your behalf and we cannot appeal on your behalf either.
By using talkv you agree that you will comply with, and are separately bound by:
- the WhatsApp Business Solution Terms;
- the WhatsApp Business Messaging Policy;
- the WhatsApp Commerce Policy, where you sell goods or services over WhatsApp; and
- the Meta Platform Terms, as they apply to data you receive through the platform.
Those documents are Meta’s and Meta may change them. Where anything in these terms conflicts with them, Meta’s terms win.
You are responsible for the phone number you connect, for the business verification behind it, and for the quality rating and messaging limits that Meta assigns to it. We will tell you what we can see about those, and we cannot change them.
4. Your talkv account
You must give accurate information when you open an account and keep it current. You are responsible for everything done under your account, including by people you invite into a workspace, and for removing people who should no longer have access.
A workspace always keeps at least one owner. This is enforced in the software: the last owner cannot be demoted, removed, or leave. It exists so that no account can end up with nobody able to administer, close, or hand it over.
You must be at least 18 years old and using talkv for a business purpose. talkv is not offered for personal or household use.
With your permission or where necessary to resolve a fault, our staff may open a support session into your workspace. A support session is read-only — enforced by the software, not only by policy — and it expires automatically. Every action taken during one is recorded in your own audit log, showing both whose account was affected and which of our operators was working.
5. How you may use talkv
Our acceptable use policy forms part of these terms and sets out what may and may not be sent. In summary, and without limiting it, you must not use talkv to:
- message anybody who has not given you opt-in consent to be messaged on WhatsApp by your business, including anybody from a purchased, scraped or rented list;
- continue messaging somebody after they have asked you to stop;
- send anything Meta’s policies prohibit, or promote goods or services in the categories Meta prohibits;
- impersonate another business or person, or send messages that mislead the recipient about who is contacting them;
- attempt to circumvent the consent, rate or template rules in the software, including by automating the interface or accessing it other than as documented; or
- use talkv in breach of any law that applies to you or to the people you are messaging.
Opt-out is honoured in the software. Where somebody replies with a recognised stop word, we record their opt-out and exclude them from later marketing broadcasts. This runs before anything else, applies regardless of your settings, and cannot be switched off.
6. Data and content
Your content stays yours. Contacts you import, templates you write, messages you send and messages your customers send you belong to you and your customers, not to us. We do not sell it, we do not use it to train models, and we do not use it to market to your customers.
We process it in order to run the service for you, and to the extent it contains personal data you are the controller (in Indian terms, the Data Fiduciary) and we act on your instructions as a processor. The detail is in our privacy policy, which forms part of these terms.
You confirm that you have a lawful basis for every contact you import, and that you can show where each person’s consent came from if you are asked. We may ask you.
Your contacts, campaigns, message history and reports are yours. An owner or admin of your workspace can download them from the console at any time, as spreadsheet files, under Settings → Your data. Deletion is covered on our data deletion page.
We own the software, the interface and everything we have written, and nothing in these terms transfers that to you. You may not copy, resell or reverse engineer it. Feedback you send us we may act on freely and without obligation.
7. Fees, the wallet and refunds
talkv is prepaid. You add a balance, and we draw from it as messages are delivered, at the rate published on our pricing page at the time of your top-up.
- You are charged on delivery, not on send. A message that is accepted by Meta but never delivered is not charged for.
- The quote is a ceiling. Before a broadcast starts we block the full amount it could cost. The charge written when it finishes is that amount or less, never more, and the difference is released to your balance.
- The rate is locked to the balance. A top-up earns a rate and that rate applies until the balance is spent. A later, smaller top-up never worsens it.
- Template messages are charged; replies are not. Every template message is charged at the same rate, whether it is part of a broadcast, sent on its own through the API, or sent from the inbox. Replies inside WhatsApp's 24-hour window and automated replies carry no fee from us.
- Balances do not expire, and there is no monthly, per-seat or minimum charge, and no minimum top-up.
Top-ups are processed by our payment gateway. We do not see or store your card details. Taxes are added where they apply and shown before you pay.
Because the balance is consumed as it is used, top-ups are generally non-refundable. We will refund an unused balance where we have ended the service without cause, where a charge was made in error, or where the law requires it. Refunds are made to the original payment method and appear on your statement as their own entry, so the history of the account stays complete.
A new account starts with a welcome credit of ₹50. It is credit we give, not money you paid: it pays our fee like any other balance, but it does not count as a top-up, does not earn a lower rate, cannot be withdrawn or transferred, and is never refunded or included in a refund. It does not cover anything Meta charges you.
Where we need to correct a balance, the adjustment appears on your own statement with the reason for it. There is no second set of books.
None of this covers what Meta charges you. Those amounts are between you and Meta, we cannot see them, and we cannot refund them.
This section is restated on its own page, as our refund and cancellation policy. Where the two differ, this section is the one that governs.
8. Availability, support and changes
We try to keep talkv available and we do not promise that it always will be. Parts of the service depend on the WhatsApp Business Platform, which is outside our control; when Meta is unavailable, or changes its API, some things here will stop working until we adapt.
Support is by email at hello@talkv.io. We answer during Indian business hours and aim to reply within one working day.
We improve the software continuously and may change it. Where a change materially reduces what you can do, we will tell you before it takes effect. Where a change is required by Meta or by law, we may have to make it with less notice than we would like.
9. Suspension and ending the agreement
You may close your account at any time, from the console or by writing to us.
We may suspend a workspace where an amount is unpaid, where we reasonably believe the acceptable use policy is being broken, or where Meta requires it. A suspension stops writes; it does not lock you out of reading your own data, and the reason is shown to you in the product. We will lift it as soon as the cause is resolved.
We may end this agreement on 30 days’ notice, or immediately for a serious or repeated breach of the acceptable use policy. On ending, your data is kept for 30 days so that you can ask us for a copy of it, after which we delete it in line with our data deletion policy.
Ending your talkv account does not affect your WhatsApp Business Account, which remains yours, with Meta.
10. Warranties, liability and indemnity
We provide talkv with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided as it is: we do not warrant that it will be uninterrupted or error-free, that any message will be delivered, or that Meta will approve any template or maintain any quality rating.
To the extent the law allows, neither party is liable to the other for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings. Our total liability arising out of or in connection with this agreement, in any twelve-month period, is limited to the greater of the fees you paid us in that period and ₹10,000.
Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
You will indemnify us against claims brought by a third party arising from the content you send, from your breach of the acceptable use policy, or from your not having consent to message somebody you messaged.
11. Governing law and disputes
This agreement is governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction, and both of us submit to them.
Before starting proceedings, please write to us at hello@talkv.io and give us 30 days to resolve the matter. Most things can be.
12. Changes to these terms, and how to reach us
We may update these terms. Where a change materially affects your rights we will give you at least 30 days’ notice by email and in the product, and the date at the top of this page will change. Continuing to use talkv after that means you accept the new version.
Questions about these terms go to hello@talkv.io. If you would rather write, the postal address is in section 1.
